Resale Consignment Agreement

By completing this form you agree that you are the rightful owner of artwork being consigned and will be referenced as the Collector, hereinafter. An email will be generated and sent to ChimMaya/CM2 Gallery (hereinafter referred to as the “gallery”) with the images you’ve attached. For your records, a copy will be sent to the email you’ve provided below.

    File Requirements: File format preferred is JPEG. File size maximum is 2 Megabytes per image attached. Minimum acceptable image dimensions are 1200 by 1200 pixels.

    NOTE: Any images attached and provided by the Collector…can be used on the website, and/or for advertising, promoting the gallery and/or exhibition, without contacting the Collector. Select exhibitions may be documented, by creating and printing a catalog. Should we print a catalog and the work is included, you will receive one complimentary copy. If the collector requests additional catalogs, they can be purchased at a discounted price. If selected for exhibition, the artwork may be made available for purchase on ChimMaya/CM2 online shopping cart.

    Pricing: Collector price, is 30% less of the ‘gallery/retail price’….e.g. $700 (Collector) $1,000 (Gallery/Retail)

    Unless previously agreed upon, the Collector is responsible for transportation of the artwork.

    Above artwork must be delivered to ChimMaya/CM2 Gallery in excellent condition and ready to hang.

    CONSENT TO HAVE ARTWORK PHOTOGRAPHED AND PUBLISHED

    I consent to have a work(s) of art provided by me (the Collector) photographed and published by ChimMaya/CM2 Gallery. I further give ChimMaya/CM2 Gallery, its assigns, licensees and legal representatives, the irrevocable right to publish said photograph(s) in all forms and media, and in all manners, including composite or distorted representations for any lawful purpose. I acknowledge that I will receive no compensation, monetary or otherwise, for the use of my image, other than one (1) copy of an upcoming book should my image become a part of said publication. I waive my right to inspect, or approve, the finished version(s), including written copy that may be created in connection therewith. As the rightful owner, I have full power and authority to enter into this agreement and give consent to ChimMaya/CM2 Gallery, who is the agent, to sell the artwork listed above. The use of said images, or any part thereof, in accordance with the terms, rights and conditions of this Consent, will not violate or infringe upon the trademark, trade name, copyright, patent, artistic, personal, private, civil or property right, right of privacy, or any other right of any person, or constitute a libel or slander of any person. The undersigned will indemnify ChimMaya/CM2 Art Gallery, and its officers, agents and employees, against and save and hold each of them harmless of and from, all loss, damage, liability and expense, including attorney fees, resulting from any breach of said representation and warranties.

    NOTE: Upon receipt of artwork, ChimMaya/CM2 Gallery will return a signed copy of the ‘Gallery/Collector Agreement’ in person, or via email.
